Position Overview

Silicon Path Law is seeking an Associate Attorney – Employment-Based Immigration with a strong foundation in employment-based immigration who is interested in developing deeper expertise in extraordinary ability petitions.

This role is well suited for an attorney with 3+ years of immigration experience who is looking to grow their skills in EB-1A, EB-1B, EB-2 NIW, and O-1 petition preparation while working closely with experienced attorneys.

The Associate Attorney will assist with case strategy, petition drafting, and client communication while developing increasing responsibility over time. The role involves helping translate complex professional achievements into clear and persuasive legal narratives aligned with USCIS extraordinary ability criteria.


Key Responsibilities


Petition Preparation

Assist in the preparation of EB-1A, EB-1B, EB-2 NIW, and O-1 employment-based petitions

Draft petition letters, legal arguments, and supporting documentation

Review client evidence and help organize materials to support eligibility criteria

Assist with responding to Requests for Evidence (RFEs) and case updates

Support case preparation from intake through petition filing and adjudication


Client Communication

Participate in client consultations and case development discussions

Guide clients through documentation and evidence collection

Provide case updates and respond to client questions in coordination with supervising attorneys

Assist in evaluating potential eligibility for employment-based petitions


Team Collaboration

Work closely with senior attorneys, paralegals, and case managers on case preparation

Maintain organized case files and documentation

Participate in internal case reviews and strategy discussions

Contribute to maintaining high-quality case preparation standards within the firm


Required Qualifications

Juris Doctor (JD) from an accredited law school

Active bar membership in any U.S. state

3+ years of immigration law experience

Experience assisting with employment-based immigration matters

Strong legal research and writing skills

Excellent organizational and time management skills

Strong written and verbal communication abilities

Ability to manage multiple cases and deadlines in a collaborative environment


Preferred Qualifications

Exposure to EB-1A, EB-1B, EB-2 NIW, or O-1 petitions

Experience working with researchers, engineers, startup founders, or academics

Interest in developing expertise in extraordinary ability petitions

Familiarity with USCIS policy guidance and petition preparation processes

Membership in AILA (American Immigration Lawyers Association)
