Pre-Litigation Personal Injury Attorney
North Charleston, SC
Full-Time, Plaintiff’s Personal Injury
Gus Anastopoulo Law Firm is a plaintiff-only personal injury practice based in North Charleston, South Carolina. We represent individuals throughout the state in motor vehicle accidents, trucking collisions, pedestrian injuries, premises liability, negligent security, and dog bite cases.
We are growing, and we need a Pre-Litigation Attorney who can own the full pre-suit lifecycle, from intake through settlement, with the strategic judgment to know when a case should move into litigation, when it should resolve, and when it should be referred out. This role is critical to our clients, our trial team, and the firm’s trajectory.
Position Overview
The Pre-Litigation Attorney manages personal injury cases from initial intake through pre-suit resolution. You will develop case strategy, direct medical management, negotiate with insurance carriers, supervise case managers, and serve as the primary decision-maker on your docket. You will work closely with the firm’s trial attorneys and, when appropriate, transition cases into litigation with a complete file.
Key Responsibilities
Intake, Investigation, and Early Case Strategy
- Review new matters at intake and conduct initial liability, causation, and damages assessments.
- Develop a written case strategy for each file within the first 30 days, identifying strengths, weaknesses, and critical deadlines.
- Direct your case managers to obtain police reports, incident reports, surveillance footage, and other foundational evidence, and review those materials for strategic implications.
- Identify cases that warrant early expert retention (accident reconstruction, etc.) and coordinate accordingly.
- Ensure timely preservation of evidence.
- Identify all potential insurance coverage, including primary, excess, umbrella, and underinsured/uninsured motorist policies, and develop a recovery strategy for each.
Medical Management and Provider Coordination
- Oversee your case managers’ tracking of client treatment progress and their collection of medical records and billing on a rolling basis.
- Review medical specials for accuracy and completeness before demand preparation.
- Identify gaps in treatment or documentation and work with your team to ensure those gaps are resolved before demand preparation.
Demand Drafting and Settlement Negotiation
- Draft demand packages that clearly present liability, medical documentation, damages, and policy limit arguments.
- Negotiate directly with insurance adjusters and defense counsel, maximizing pre-suit recoveries for clients while keeping clients informed at every stage.
- Secure client authority for settlements and manage the disbursement and lien resolution process.
Case Evaluation and Litigation Pipeline
- Evaluate each case for litigation potential, identifying strong cases that should be filed and preparing the file for a clean handoff to the trial team.
- Participate in regular file reviews and strategy meetings with firm leadership and trial attorneys.
Team Supervision and Client Service
- Supervise and coach a team of case managers and support staff assigned to your docket.
- Maintain consistent, proactive communication with clients, ensuring they understand their case status, next steps, and realistic expectations.
- Ensure all files comply with firm workflows, deadlines, and quality standards.
Qualifications
Required
- Juris Doctor from an accredited law school and active South Carolina Bar membership.
- 2 to 5+ years of experience handling plaintiff’s personal injury matters, with demonstrated pre-litigation case management from intake through resolution.
- Experience with South Carolina personal injury and law, including insurance regulations.
- Strong negotiation skills with a track record of favorable pre-suit settlements.
- Excellent client communication. You can explain complex legal and medical concepts in plain English, set realistic expectations, and deliver hard news with care.
- Ability to manage a substantial docket of active matters while maintaining attention to detail on each file.
- Prior experience supervising and directing case managers and support staff.
