Pre-Litigation Paralegal

Our client, a well-respected and established Law Firm, is seeking a Pre‑Litigation Paralegal to support attorneys in managing all pre‑litigation personal injury cases from intake through settlement.


Requirements:

  • 2+ years’ experience as a Paralegal, Plaintiff PI preferred but possibly open to other similar backgrounds (e.g. Mass Torts, Asbestos, PI Defense)
  • Bachelor's or associate degree highly preferred
  • Strong tenure is highly valued by this firm


Specific Areas of Responsibility

Client Management

  • Maintain regular communication with clients in accordance with firm guidelines:
  • Treating clients: every 15 days
  • Non‑treating clients: every 30 days
  • Return all client calls promptly.
  • Provide status updates, schedule appointments, and ensure client concerns are addressed professionally.

File Management

  • File Setup: Enter, verify, and organize initial intake information in case management software.
  • Initial Claim Investigation: Obtain and document insurance information, coverage, and policy limits.
  • Collect property damage photos, injury documentation, and accident‑related evidence.
  • Incoming Mail: Review mail received via USPS, email, or fax.
  • Scan, properly name, and upload documents into the client’s electronic file.
  • Outgoing Mail: Prepare correspondence and send via mail, email, or fax as directed by the attorney.
  • Scan and save all outgoing communication to the client file.
  • Data Management: Maintain accurate, up‑to‑date entries in all case management fields and objects.
  • File Progression: Conduct regular file reviews with attorneys to ensure cases progress appropriately.
  • Maintain client contact and ensure medical treatment is ongoing.
  • Settlement Demands: Draft comprehensive settlement demands, including medical summaries, treatment chronology, and damages.
  • Coordinate attorney review and ensure timely submission to carriers.

Medical Management

  • Provider Coordination: Enter medical providers into the system; monitor and schedule treatment as needed.
  • Records & Bills: Request medical records and bills promptly.
  • Ensure all PDFs are properly titled and stored in the designated medical sub‑folders.
  • Expense Tracking: Enter and update medical expenses, maintaining accurate balances.
  • Medical Summaries: Review medical records and prepare organized medical summaries and treatment timelines for demand packages.

Calendar & Scheduling

  • Maintain the attorney’s calendar for all client meetings, IMEs, statements, or pre‑suit mediations.
  • Track and document important case deadlines within the pre‑litigation phase.
  • Schedule depositions, if applicable during pre‑litigation (e.g., EUOs or recorded statements).

Pre‑Suit Tasks

  • Assist attorney with gathering all evidence needed to evaluate claims prior to litigation.
  • Communicate with insurance adjusters, providers, and lienholders.
  • Ensure all documents required for settlement (e.g., wage loss documentation, property damage estimates, liens) are collected and organized.

Disbursals

  • Verify outstanding balances for all medical providers; confirm lienholder information.
  • Confirm referral or prior counsel details in the case management system.
  • Update the Settlement Disbursement Report bi‑weekly.
  • After settlement, ensure all necessary documents are scanned into the file.
  • When appropriate, send Google review link to satisfied clients.
