Associate Attorney - Litigation

Desmond, Rand & Guerard, P.A. is seeking a motivated, resourceful, and entrepreneurial Associate Attorney to join our litigation practice. This position offers a unique opportunity to work directly and closely with the firm’s Litigation Group Chair and clients on a wide range of litigation matters, with meaningful responsibility and client exposure from day one.

Position Overview:

This is an in office position based primarily in our Westbrook office, with the option to work from our Wells office as needed. The Associate will work side by side with the firm’s Litigation Group Chair, gaining hands on experience in active litigation matters and participating directly in case strategy, drafting, and courtroom preparation. This is not a back office role. The Associate will be integrated into client relationships early and expected to develop practical judgment and confidence quickly.

Early responsibility, including court appearances and direct client interaction, will be provided.

The ideal candidate will have one to two years of litigation experience; however, we are willing to train the right individual who demonstrates initiative, sound judgment, and a strong desire to grow within the firm.

We are looking for someone who brings an entrepreneurial mindset, is creative and aggressive in problem solving, and is comfortable handling a broad range of litigation matters to meet client needs.

Practice Areas Include:

• Business and commercial litigation
• Real estate litigation
• Construction and contract disputes
• General civil litigation
• This role will also provide cross exposure to transactional matters, as well as trusts and estates issues, offering a more complete understanding of how disputes arise and are resolved.

Responsibilities:

• Work directly with the firm’s Litigation Group Chair on active matters
• Draft pleadings, motions, and legal memoranda
• Conduct legal research and develop case strategy
• Participate in discovery, including document review, drafting discovery requests and responses, and depositions
• Prepare for and assist with hearings, mediations, and trials
• Communicate directly with clients, opposing counsel, and the court
• Manage files proactively and meet deadlines in a fast paced environment

Qualifications:

• Licensed to practice law in Maine or ability to obtain licensure promptly
• One to two years of litigation experience preferred, but not required
• Strong writing, analytical, and oral advocacy skills
• Entrepreneurial mindset with a willingness to take ownership and contribute to practice development
• Ability to think critically, act decisively, and solve problems creatively
