Experienced Trusts & Estates Attorney

Location: Primarily Remote (Flexible/Variable Office Hours)

Position Type: Full‑Time


About the Role

Our firm is seeking a highly experienced Trusts and Estates Attorney with 5 plus years of experience to join our team. The ideal candidate will be fully versed in trust and estate law and capable of independently managing matters from initial client intake through final resolution. This is a great opportunity for someone who values autonomy, high‑quality legal work, and a flexible, mostly remote environment.

Litigation experience involving trusts and estates matters is highly valued and considered a significant plus, though not mandatory.


Key Responsibilities

The successful candidate will be expected to perform the full scope of duties typically required in a trusts and estates practice, including:

Estate Planning

  • Conduct client consultations to understand goals, assets, and family dynamics
  • Draft, review, and revise estate planning documents, including:
  • Wills
  • Revocable and irrevocable trusts
  • Powers of attorney
  • Advance health care directives
  • Gift planning instruments
  • Provide sophisticated tax planning advice related to federal estate, gift, and generation‑skipping transfer taxes
  • Advise high‑net‑worth clients on wealth transfer strategies and succession planning

Trust & Estate Administration

  • Guide trustees, executors, and beneficiaries through probate and non‑probate administration
  • Prepare and file probate petitions and related court documents
  • Marshal, inventory, and value assets
  • Address creditor claims and supervise payment of obligations
  • Coordinate preparation of estate, fiduciary, and gift tax returns
  • Manage trust funding and distribution processes
  • Interpret trust instruments and advise fiduciaries on compliance

Client Counseling & Case Management

  • Manage matters independently with minimal supervision
  • Maintain strong professional communication with clients, fiduciaries, beneficiaries, and co‑professionals
  • Provide strategic advice, risk assessment, and clear explanations of complex legal matters
  • Maintain organized case files and deadlines from intake to conclusion

(Optional but Preferred) Litigation

  • Handle or assist with trust and estate disputes, including:

Will contests

Breach of fiduciary duty claims

Accounting disputes

Interpretation issues

Draft pleadings, motions, discovery, and negotiate settlements


Qualifications

  • J.D. from an accredited law school
  • Licensed and in good standing with the Utah state bar
  • 5 plus years of trusts and estates experience
  • Strong drafting, analytical, and communication skills
  • Ability to work independently and manage a full caseload
