MajorDuties

  • The Deputy GC is the principal advisor to the General Counsel with respect to the management, oversight and direction of the General Law program which provides oral advice and written legal opinions concerning (1) the administration and management of the Commission in areas which, in general, are governed by statutes, (2) ethics, and (3) labor and employment. Plans, organizes and directs the general law program dealing with the establishment of program policies and plans, defining program goals, and objectives and determining organization and resources necessary to meet program requirements. Provides legal guidance on issues concerning the agency's budget, debt collection efforts, fee structures and other fiscal policies, and the DA in the review of agency policies, procedures, and in the interpretation of applicable appropriation laws. Provides advice and guidance on applicable employment and labor laws, employee performance issues, and adverse and disciplinary actions Incumbent provides legal guidance on the management and operations of the Federal Advisory Act Committees. Provides legal guidance on agency operations, Commission processes, and ensures compliance with provisions of the Sunshine Act. Performs other duties as assigned. EXECUTIVE AND MANAGERIAL RESPONSIBILITIES The Deputy General Counsel serves as the alter ego of the Director and provides executive direction and oversight and shares fully in the planning, organizing, directing, controlling, and coordinating the Branch. Establishes and evaluates the goals, and the progress made toward achieving them, and institutes policies and procedures directed toward improving the efficiency and effectiveness of the Branch. Manages the human, financial and material resources of the Branch. Builds coalitions with other CFTC Directors and maintains effective relationships with regulated industry participants, other agencies, members of Congress and other interested parties. Assigns and reviews work of subordinates. Sets work priorities and assures timely performance of a satisfactory amount and quality of work. Delegated authority to subordinates to direct and manage operations under their immediate control. Makes decisions on major policy and work issues presented by subordinates. Coordinates with other appropriate supervisors within the Division on work-related changes affecting their Branches. Advises the Director on problems involving the relationship of the work of the Branch to the work of the Division. Develops performance standards and prepares performance ratings for positions supervised. Serves as rating or reviewing official as appropriate. Interviews and recommends selections for supervisory and non-supervisory positions. Hears grievances and serious employee complaints not resolved at a lower level; reviews serious disciplinary cases such as those proposing suspension or removal. Assures that employees in the branch/section/unit receive appropriate and necessary training. Promotes and assures equal employment opportunities.

Education

Successful completion of a full course of study (J.D.) in a school of law accredited by the American Bar Association (ABA).
