Our company is seeking a self-motivated, experienced construction litigation attorney to serve as General Counsel, advising on a wide range of legal matters in support of projects in California and Arizona. The General Counsel works closely with the executive team, project teams, the safety office, human resources, and accounting to manage risk, resolve conflicts, and guide compliance with applicable laws, regulations, and contracts. Working independently and with outside counsel, and in coordination with insurance carriers and adjusters, the General Counsel oversees and directs all litigation and claims, including government and private contract claims, personal injury litigation, and employment litigation. This is a full-time in-office position (not remote).
Responsibilities
- Analyze contracts, specifications, and laws and provide legal guidance and advice to all departments of the company.
- With the support of the contracts administrator, draft, review, and negotiate all project related contracts, commercial real property leases, equipment rental agreements, and other legal documents; regularly monitor and update contracts in accordance with legal developments.
- Manage and maintain corporate compliance and filings.
- Develop arguments, draft, and respond to bid protests and other pre-contract disputes in government contracting.
- Oversee and manage all construction and insurance-related claims and lawsuits, working with project team, outside counsel, and experts.
- Draft, review, and ensure accuracy of and full compliance with all discovery responses, demands, public record requests, claims, complaints and other pleadings, Statements of Exceptions to PFE, requests for equitable adjustment, mediation and trial/arbitration briefs and Power Points, notice documents, and all other similar documents.
- Maintain close communication and relationships with insurance brokers, carriers, adjusters, and panel counsel to ensure all insurance matters are properly covered and handled, including insurance defense of personal injury and employment cases.
- Monitor updates and changes in all relevant laws, including but not limited to the California Government Code, Public Contract Code, and Labor Code as they relate to government contract work.
- Work with company management to address and minimize employment and labor issues including Union grievances, PAGA claims, and other employment claims.
Qualifications
Must have:
- Juris Doctorate degree
- Active license to practice law in California in good standing.
- 5+ years of experience in construction litigation (In-house counsel experience is a plus)
- Familiarity with labor and employment law a plus
- Strong knowledge and understanding of laws relating to state and federal public construction contracting and subcontracting, including indemnity, insurance obligations, prompt payment requirements, prevailing wage, payment and performance bonds, mechanics liens and stop notices, the bid and bid protest processes, and subcontractor listing requirements.
