Our client is moving to full commercialization of their technology, and require the services of an experienced Contracts Manager to work with their team in Houston, TX.

 

The successful Contracts Manager candidate plans and strategizes the development and implementation of contracting activities by promoting value adding initiatives that leverage on the industry’s best practices, as well as maintaining a high degree of integrity, and proactively executes and monitors contractors' performance toward safe and timely completion of contracts in the most economical and professional manner.

 

Key Duties and Responsibilities:


  • Lead and drive the development and implementation of contract management activities, initiatives and processes for effective performance management of contracts and compliance management by strategizing interventions, developing supplier relationships and managing project cost in order to sustain value creation identified for all contracting activities.


  • Lead and drive the management of contractor, subcontractor’s and supplier’s work performance and compliance to contractual terms and conditions through the establishment of a tracking mechanisms (contract Price, performance securities, contract conditions and etc.), review, assessment and reporting of supplier performance as well as recommending mitigation measures in addressing any relevant issues to ensure no delay or interruption to projects execution and operations in order to sustain business operations.


  • Manage contract disputes by developing strategies to resolve issues related to project and operational contracts, analyzing the situations, providing recommendation and guidance, participating in and contributing to negotiations with respect to disputes, claims, non-compliance etc. in resolving issues over interpretation of contractual terms and contract execution discrepancies in order to safeguard the shareholders’ interest and reputation.


  • Lead and drive the economies of scale initiatives by consolidating project and operations information and synergizing common sourcing items (including category management items) to extract best value for investment for the organization’s shareholders from the group’s portfolio of projects and operations in order to sustain business growth.


  • Manage the maintenance and administration of contract documentation and act as a one-stop resource center for matters pertaining to contract records, contractors' data, bidders' list etc. in order to sustain the reliability and availability of open/classified information at all times, as well as for reference during negotiations and disputes.


  • Optimize taxes and duties payable arising from contracts by leveraging and taking advantage of available allowances and waivers on investment tax and stamp duties in minimizing costs related to project contracts as well as to extract maximum value creation.


  • Manage urgent and ad-hoc requirements and non-contractual issues (e.g. settlement) through optimization, planning and coordination of available resources, evaluation and elimination of business risks due to the urgency of requirements in order to provide total quality solutions in ensuring compliance with the agreed quality and/or project and operational schedules.


  • Strategize plan to instill continuous awareness amongst Team on Contract / Contractor's Risk Assessment process during project implementation phase and operations; and proactively institute a system that measure, monitor and mitigate risks in order to eliminate/ minimize risk of non performance of Contractor(s) that may lead to cost overrun or project and operational delays.


  • Review claims and variances by analyzing and proposing methods for contract variations (i.e. change orders, liquidated assessed damages, end-of-time) and claims by contracting parties in order to control change orders and claims to become standardized and efficient with minimal deviation to original plan and budget.


  • Foster and sustain effective working relationships and rapport with the government authorities, business and management institutions, national and key industry players and service providers in order to keep abreast with latest development in the relevant markets and capitalize on insider status and strategic alliances to capture opportunities for new business ventures and enhance public confidence in the company business solutions, products and services.


  • Communicate, interpret and champion the execution of the objectives and provisions of the Health, Safety and Environment (HSE) policies and Codes of Conduct (COC) and undertake appropriate mitigation and/or intervention programs to safeguard business operations, high staff discipline and industrial harmony.


  • Enforce the implementation of applicable organization procedures and guidelines and the compliance with statutory and legislative requirements and conformance to the established Limits of Authority (LOA), group wide policies and government regulations to safeguard the organization and shareholders’ integrity and image as a responsible multinational company.


  • Drive the development of competent working team that will enhance and sustain staff capabilities in achieving high performance delivery to ensure internalization of the right leadership and capabilities in executing their jobs.


  • Develop and implement distinctive mindset, behavior and culture to achieve high work performance by adoption and implementation of value interventions, tools and methodologies to promote and instill high sense of commitment, ownership, integrity and loyalty that will contribute to operational excellence.

Experience and Qualifications Requirements:

 

  • Bachelor’s Degree or professional certification, preferably in supply chain management, contracting, procurement, business administration or economics.
  • 15+ years working experience in heavy industrial sector, major EPCC/EPCM projects or large industrial plant setting.
  • Demonstrated track record of Contracts Management and Administration for Greenfield Capital Projects in excess of $1B USD.
  • Requisite levels of technical knowledge to successfully interact with a range of engineering / technical and construction disciplines and associated fields of work.
  • Excellent verbal and written communication skills in English.
  • Demonstrated proficiency with complex major capital Contract Drafting, Contract Formation, Contract Negotiations, and Administration is required.
  • Proficiency in the planning and control of work in a multi-project, deadline driven environment.
  • An understanding of applicable regulatory agencies and requirements.
  • Extensive knowledge of a variety of standard engineering methods, technologies and computerized design techniques.
  • Ability to develop strong working relationships with all levels of individuals is essential.
  • Ability to prioritize work and strong organizational skills.
  • A strong initiative; proactive approach to problem solving.

 

Working Environment:

  • Must be comfortable with high-levels of responsibility and accountability exposure.
  • Must be able to function in complex and matrix environments including multiple work locations and centers of activity.
  • This position will require travel to site in the continental US.
  • Site assignment during Construction Phase may require a rotation schedule.
  • Base of Operations for this role is Houston, TX.
  • Project Site Location is the Southeastern region of the US
