Auto Industry Division

The Auto Industry Division is responsible for regulating the Motor Vehicle and Powersports Industry with balanced emphasis on Education, Compliance, and Enforcement of applicable laws and regulations. The Division regulates with fundamental fairness by ensuring that three key components are the primary focus:

  • Educate and protect consumers;
  • To treat applicants and licensees fairly, professionally, courteously, and efficiently;
  • To foster an honest and healthy industry within the State of Colorado and to ensure consumer confidence for the manufacture, distribution and sale of all vehicles within the Division's jurisdiction.

The unit is charged with ensuring that all licensees comply with Title 44, Article 20, parts 1 & 4 of the Colorado Revised Statutes and the related promulgated rules of the Colorado Motor Vehicle Dealer Board in addition to various federal laws and regulations. This is accomplished by the formulation of effective and efficient licensing procedures, quality background investigations of licensees and/or licensee applicants, and complete and thorough enforcement investigations. When appropriate, this unit can issue licenses, refer licensing decisions to the Motor Vehicle Dealer Board, close investigations or refer investigative results to the Board for administrative decisions and/or the local District Attorney for criminal filings.

The Auto Industry Division is seeking anAgent-In-Chargeto manage and lead our Investigation section. This vital leadership role is charged with ensuring that all licensees comply with Title 44, Article 20, parts 1 & 4 of the Colorado Revised Statutes, the rules of the Colorado Motor Vehicle Dealer Board, and relevant federal laws.
Primary Duties & Responsibilities:
Leadership & Supervision
  • Supervise the Enforcement Unit, directly overseeing staff including three Criminal Investigator V's and an Intake Coordinator.
  • Manage daily operations by scheduling work, making task and case assignments, and reviewing and correcting work products.
  • Conduct performance plans and evaluations, provide routine counseling and guidance, investigate employee complaints, and initiate disciplinary actions when necessary.
  • Ensure all criminal investigators complete mandatory training, including rigorous compliance with Colorado Crime Information Center (CCIC) and National Crime Information Center (NCIC) system policies and federal codes.
Enforcement Strategy & Foundational Knowledge
  • Apply advanced technical skills to oversee bothadministrative actions and criminal enforcementwithin the division.
  • Maintain extensive, up-to-date knowledge of AID laws, regulations, and departmental policies to make critical decisions regarding regulation changes and process improvements.
  • Demonstrate innovation and adaptability to implement new programs and improve daily operations in a fast-paced, evolving regulatory environment.
Auto Industry Oversight & Case Management
  • Review, approve, anddirect all major criminal and administrative case filingsprepared by investigative staff.
  • Make high-level determinations on whether investigations should be referred to the Motor Vehicle Dealer Board for administrative hearings or forwarded to the District Attorney or Attorney General's Office for criminal charges.
  • Safely manage and maintain highly confidential records, including undercover identifications for investigators and employee background files.
Stakeholder Communication & Support
  • Serve as a point of contact, communicating regularly with county clerks, licensees, attorneys, lobbyists, and other stakeholders regarding complex enforcement activities, laws, and legislative changes.
  • Approve and respond toColorado Open Records Act (CORA) requestsin the absence of the Deputy Director, carefully reviewing documents for necessary redactions of protected information.
  • Foster a positive and professional image of the Division by demonstrating teamwork, accountability, integrity, and fair-mindedness while interacting effectively with people from diverse backgrounds

MINIMUM QUALIFICATIONS:
Experience Only:

Eleven (11) years of relevant experience inconducting, reviewing, analyzing, and/or interpreting investigative actions equal to eleven (11) years, two (2) of which must have been at the level of a work leader, staff authority, unit supervisor, or equivalent.

AND

* Active/Valid Colorado P.O.S.T. Certification

OR

Education and Experience:

A combination of related education and/or relevant experience in conducting, reviewing, analyzing, and/or interpreting investigative actions equal to eleven (11) years, two (2) of which must have been at the level of a work leader, staff authority, unit supervisor, or equivalent.


AND

* Active/Valid Colorado P.O.S.T. Certification

NECESSARY REQUIREMENTS:
  • Must be currently certified as a Peace Officer in the state of Colorado by POST at the time of application.
  • Must be willing to work nights, rotating shifts, weekends, and holidays and maintain on-call status while off-duty for emergency response. Must be willing to travel in and out of state as required.
  • Applicants must successfully pass a background investigation and a tax check prior to appointment to the position in the Auto Industry Division.
  • Applicants must possess and maintain a Colorado driver's license.

PREFERRED QUALIFICATIONS and COMPETENCIES

  • Strategic Planning development and implementation.
  • Development and implementation of program policies, rules, and procedures that ensure appropriate regulation while meeting customer needs.
  • Analyzing data and developing solutions to improve the efficiency and effectiveness of operations.
  • Experience in a public service environment at the state, county, local level.
  • Experience in training.
  • Experience in writing rules, statutes and legal policies.
  • Experience working with automobile and powersports regulations and statutes.
  • Experience working with the Office of the Attorney General on administrative actions and making recommendations.
  • Experience with rule making processes in a regulated industry.
  • Experience supervising administrative investigations in a regulated environment.
  • Working closely with senior executives to achieve organizational vision, mission and goals/objectives.
  • Experience in Auto IndustryStatutes and related regulatory materials and exposure to federal laws and regulations pertaining to automobile and powersports manufacture, distribution and sales.
  • Experience in investigative review and policy issues within a highly regulated industry is a plus.

Pursuant to theUniversal Driving Standards Policy, any worker who will be expected to drive a State-owned vehicle is responsible for maintaining a safe driving record and a valid driver license prior to driving any State-owned vehicle.

To be compliant with the new fleet vehicle policy, Motor Vehicle Records (MVRs) will be pulled for review for workers who:

  • Have an assigned State fleet vehicle

  • Are required to operate a vehicle as part of the position

  • Utilize a State fleet vehicle as a pool vehicle
